1. These terms
These terms are an agreement between you and [Longway Media legal name], [registered address] (“we”, “us”), the maker of KitStudio. They cover the KitStudio app and the website kitstudio.app. By using KitStudio you agree to them. Our privacy policy explains how we handle your data.
2. Who can use KitStudio
You must be at least 13 years old. If you're under 18, or under the age of majority where you live, a parent or guardian should agree to these terms with you.
3. Your account
You can design as a guest. A free account keeps your kits online and lets you create or join a team. Keep your sign-in details to yourself and tell us if you think someone else is using your account. You're responsible for what happens in your account.
4. Your designs
Your designs are yours. That includes the kits you make, your team name, and the logos and fonts you upload, as far as you have rights in them.
So that KitStudio can work, you give us a worldwide, free license to store, copy, process and show that content, only to run the app for you: saving and syncing your kits, showing them to your team, and making pictures, order sheets and links you ask for. This license ends when you delete the content or your account, except for copies your teammates already have in a team you shared it with.
We won't use your designs in our marketing without asking you first.
You can use your designs on real kits. You may share pictures of your designs anywhere and use the pictures, order sheets and production packs KitStudio makes to have kits made for your own team, school, club or event. The fonts in KitStudio are open-licensed and can be printed on kits.
5. Logos, names and trademarks
Only upload logos, crests, names and pictures you have the right to use. Don't upload the logos of clubs, leagues, federations or brands that haven't given you permission, and don't use KitStudio to make counterfeit kits.
The ready-made kits in KitStudio are inspired by the colors of countries and well-known kits. They aren't official, and no club, federation, league or brand made, endorses or is connected to them or to KitStudio.
If you own a right and think something in KitStudio breaks it, report it as described on our support page. We review every report, remove content that breaks these terms and may close accounts that do so repeatedly.
6. Using KitStudio fairly
Don't:
- upload content that is illegal, hateful, sexual, violent or harasses anyone,
- pretend to be someone else or to speak for a club or brand you don't represent,
- add people to a team against their wishes,
- copy, extract or reuse the 3D models, patterns, textures, templates or code inside KitStudio, or try to get around how the app protects them,
- break, overload or get unauthorised access to KitStudio or its servers, or use bots to use it,
- resell KitStudio or offer it as part of another service without our written permission.
We may remove content or suspend accounts that break these rules. Where we can, we'll tell you why.
7. Our content
KitStudio itself, including the app, its 3D models, patterns, templates, design and name, belongs to us or the people who license it to us. We give you a personal, non-exclusive license to use the app to design kits as these terms allow. Nothing else in KitStudio is transferred to you. Kits you design with our patterns and templates can be used as section 4 describes.
8. Purchases and subscriptions
- Team Pack is a one-time purchase for one kit. It stays with that kit on your account.
- Pro is a yearly subscription. It renews automatically at the end of each year unless you cancel at least 24 hours before the renewal date in your App Store or Google Play settings. Deleting the app doesn't cancel it.
- Free trial: if a Pro free trial is offered, the paid plan starts when the trial ends unless you cancel before then. The trial opens everything except the order sheet and the production pack, which come with a Team Pack or a paid Pro plan.
- Payment and refunds are handled by Apple or Google under their terms. We can't refund store purchases ourselves.
- Prices are shown in the app before you buy and may change. If we raise the price of Pro, you keep your current price for as long as your subscription renews without a break.
- What's free and what's paid may change over time. We won't take away anything you've already paid for while it's paid for.
Nothing in these terms limits rights you have under consumer law where you live.
9. Ads
KitStudio may show ads, including ads you choose to watch in exchange for a reward. Rewards are given by the app and have no cash value.
10. Real kits and colors
KitStudio is a design tool. We don't make, sell or deliver kits, and we're not part of any order you place with a kit maker. Colors on a screen look different from printed fabric, and every maker prints differently. Check names, numbers, sizes and colors with your kit maker, and ask for a sample, before you order.
11. Our responsibility
We work hard to keep KitStudio running and your kits safe, but we provide it “as is”. We can't promise it will always be available or free of errors, and we may change or stop features. Keep the pictures of designs that matter to you.
As far as the law allows, we aren't responsible for indirect losses, lost profits, or problems with kits made from your designs, and our total responsibility to you is limited to what you paid us in the 12 months before the problem. These limits don't apply where the law doesn't allow them, such as for death or injury caused by negligence, or fraud.
12. Ending your use
You can stop using KitStudio and delete your account at any time in the app, under Profile. We may suspend or close an account that seriously or repeatedly breaks these terms. If we close an account by mistake, write to us and we'll put it right.
13. App Store and Google Play
If you got KitStudio from the App Store, these terms are between you and us. Apple is not a party to them. Apple isn't responsible for KitStudio, its content, maintenance or support, or for any claims about it, including product claims, legal compliance and third-party rights claims. If KitStudio fails to work as promised, you can tell Apple and Apple will refund the purchase price, if any. Apple has no other warranty duty. You must follow the App Store's rules when using KitStudio. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. The same applies to Google if you got KitStudio from Google Play, under Google Play's terms.
14. Changes and the law
We may update these terms. We'll change the date at the top and, for important changes, tell you in the app before they apply. If you keep using KitStudio after that, the new terms apply.
These terms are governed by the laws of [Türkiye], and the courts of [Istanbul] will settle disputes. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in and can bring a claim there.
